Title: Use a declared lost iPhone?

Hi,
my cousin reported his iPhone 5 lost so he could get a new one from the insurance. I live in another european country. Do you reckon it is safe for me to use that phone without him risking problems? Activation lock is off and when checking IMEI online, it says it is not reported stolen nor lost..

Work harder and get yourself a new phone, local MSP could locate the phone and report to police while insurance company filed the report
